Article 5: Client Obligations and Responsibilities regarding VPS and Dedicated Servers

The delivery of a VPS includes the provision of resources.

These are limited and governed by the offer chosen by the Client, the details of which are available on the company's website. These include, in particular, disk space, RAM, CPU, and Internet traffic. HOLYCLOUD then has only an obligation of means towards the Client, which means that it undertakes to implement the necessary means to ensure the proper functioning of the services, without however guaranteeing an absolute result.

When using VPS and Dedicated Servers, the Client undertakes to:

5.1 Retention of rights

• Rights to content: Ensure that they hold all necessary rights to the files, applications, and content they host on their VPS or Dedicated Server.

5.2 Legal compliance

• Compliance with legislation: Comply with legislation in force in France. Content of a pornographic, racist nature, promoting terrorism, or otherwise unlawful under the law is strictly prohibited.

5.3 Security and integrity

• Protection of infrastructure: Not use scripts, programs, or tools that may harm the infrastructure of HOLYCLOUD or that of other customers.
• This includes, but is not limited to, spam activities, denial of service, or any form of intrusion.

5.4 Responsibility for activities

• Non-intrusion: Not attempt to access external systems or networks without authorisation, including the abusive use of other customers' resources.

5.5 Incident notification

• Incident reporting: Notify HOLYCLOUD immediately in the event of suspected security incidents, such as hacking or abusive use of their VPS or Dedicated Server.

5.6 Responsible use

• Responsible use: Use their VPS or Dedicated Server responsibly, ensuring that they do not exceed allocated resources and comply with the terms of use of the services provided.

5.7 Maintenance and backup

• Data backup: Keep copies of their data and configurations on a medium other than the VPS or Dedicated Server itself, in order to avoid any data loss.

5.8 Specific prohibitions

• Use as a seedbox: Notify HOLYCLOUD, via a sales ticket, of the use of their VPS as a seedbox or for other unauthorised uses.

5.9 Suspension in the event of abuse

If any of the points mentioned above is breached, HOLYCLOUD reserves the right to suspend the VPS or Dedicated Server service without notice and to transmit the information of the offending Client to the competent authorities if necessary.
