Terms of sale

BETWEEN:

The Client, hereinafter referred to as the User or the Client

AND:

GENIUSWEER SAS, registered with the National Institute of Statistics and Economic Studies under number 983165820

1. Definitions

This clause is intended to define the various essential terms of the contract:

• User: this term refers to any person who is registered on the site or uses one of the services offered by our site.
• User content: this refers to the data transmitted by the User within the site.
• Member: the User becomes a member when they are identified on the site.

This is the set of information necessary to identify a User on the site. The username and password allow the User to access services reserved for site members. The password is confidential.

2. Contract Evolution

HOLYCLOUD reserves the right at any time to modify the clauses set out in this contract.

4. Duration

The duration of this contract is indefinite. The contract takes effect with respect to the User from the use of the service.

5. Obligations

Ensure access to the server 24 hours a day, every day of the year.

In cases of absolute necessity, HOLYCLOUD reserves the possibility of interrupting the server in order to carry out technical work to improve its operation or for any maintenance operation.

HOLYCLOUD undertakes to exercise all due care and diligence necessary to provide a quality service in accordance with professional standards and the state of the art.

6. Payment Terms

Payment for services provided by HOLYCLOUD is made at the time of order by:

• PayPal (www.paypal.com)
• Paysafecard (www.paysafecard.com)
• Bank card via Stripe (www.stripe.com)

7. Applicable Law — Disputes

These terms are governed by French law. In the event of difficulties in their application, the User shall have the opportunity, before any legal action, to seek an amicable solution.

In the event of a dispute with the Client, HOLYCLOUD reserves the right to suspend the Client's services/contracts at any time until the dispute is resolved.

8. Service

HOLYCLOUD reserves the right to suspend its operations for maintenance or updating of its services. HOLYCLOUD will notify Clients of planned maintenance or update operations, without being bound by any guarantee or compensation of any kind with respect to Clients.

9. Duration, Renewal & Termination

The rental contract is initially concluded for a contractual term chosen at the time of order. The service contract is governed by these general terms of use and rental. The rental begins from the date the service is made available to the Client by HOLYCLOUD.

In the event of failure by the User to fulfil their obligations or failure to comply with these general terms of sale, HOLYCLOUD reserves the right to terminate the contract or suspend it without notice or compensation.
