1. Purpose
These general terms of use govern the framework within which HolyCloud provides the Client with the service to which the Client has subscribed. These general terms of use are governed by French law. These general terms of use may be supplemented by specific terms. The general terms of use must be accepted by any User wishing to access the site. They constitute the contract between the site and the User. Access to the site by the User signifies acceptance of these general terms of use.
In particular:
- If the User does not accept the general terms of use set out in this contract, the User must refrain from accessing the services offered by the site.
- HOLYCLOUD reserves the right to unilaterally modify the content of these general terms of use at any time.
2. Definitions
This clause is intended to define the various essential terms of the contract:
- User: this term refers to any person who is registered on the site or uses one of the services offered by our site.
- User content: this refers to the data transmitted by the User within the site.
- Member: the User becomes a member when they are identified on the site.
This is the set of information necessary to identify a User on the site. The username and password allow the User to access services reserved for site members. The password is confidential.
3. Intellectual Property

Any content posted online by the User is their sole responsibility. The User undertakes not to post content that may harm the interests of third parties. Any legal action brought by an injured third party against the site shall be borne by the User.
User content may be deleted or modified by the site at any time and for any reason. The User receives no justification or prior notification before the deletion or modification of User content.
4. Personal Data
The information requested when registering on the site is necessary and mandatory for the creation of the User's account. In particular, the email address may be used by the site for the administration, management, and operation of the service.
The site provides the User with the collection and processing of personal information in compliance with privacy requirements under Law No. 78-17 of 6 January 1978 relating to data processing, files, and civil liberties. The site is registered with the CNIL under exemption number DI-006.
The only third party that may have access to the data is the judiciary, which, as part of a judicial investigation, may request access to personal information.

5. Liability and Force Majeure
The sources of information published on the site are deemed reliable.
However, the site reserves the right not to guarantee the reliability of its sources. The information provided on the site is for informational purposes only. Accordingly, the User alone assumes full responsibility for the use of the information and content on this site.
The User must keep their password secret. Any disclosure of the password, in any form, is prohibited. The User assumes the risks associated with the use of their username and password. The site declines all liability.
Any use of the service by the User that directly or indirectly results in damage must give rise to compensation in favour of the site.
The site does not guarantee optimal security and confidentiality of transmitted data. However, the site undertakes to implement all necessary means to ensure the best possible security and confidentiality of the data.
Furthermore, HOLYCLOUD cannot be held liable in the event of unlawful use of any of its services. It undertakes to provide the competent authorities with all information necessary to identify and apprehend a suspect.
6. Hyperlinks
Many outgoing hyperlinks are present on the site; however, the web pages to which these links lead in no way engage the liability of HolyCloud, which has no control over these links. The User therefore undertakes not to hold the site liable regarding the content and resources relating to these outgoing hyperlinks.
7. Registration Conditions
A person holds an account with HolyCloud when they have correctly completed the registration form and have read and approved these general terms of sale and use.
The Client undertakes to provide accurate identity and contact details. Following the creation of the Client's Account, the Client receives an email acknowledging the opening of their account, containing the information necessary to log in to their account.
HOLYCLOUD reserves the right to request the User's identity card for verification in the event of suspected fraud.
8. Service Availability
HolyCloud endeavours, as far as possible, to maintain all its services 7 days a week and 24 hours a day, but is under no obligation to do so.
HolyCloud may therefore interrupt access, in particular for maintenance and upgrade reasons, or for any other reasons, including technical reasons.
HolyCloud is in no way responsible for these interruptions or for the consequences that may result for the Client or any third party.
9. Backups
With regard to backups, we guarantee weekly/monthly backups; if you experience a problem, you are responsible for any lost data.
